These general terms and conditions of sale (hereinafter referred to as "GTC") as well as the sections "Personal Data" and "Legal Notices" apply to the e-commerce website www.myriamkparis.com (hereinafter referred to as "the Myriam•K Paris® online store"), offering the sale of cosmetic products of the Myriam•K Paris® brand (hereinafter referred to as "the Products") intended for delivery in metropolitan France, Corsica, Monaco (excluding post boxes), Europe, and the world (hereinafter referred to as "the Territory"). Any order placed on the Myriam•K Paris® online store constitutes full and unconditional acceptance of these GTC by the customer making a purchase (hereinafter referred to as "the Customer"). These GTC can be saved and/or printed and are accessible from all pages of the Myriam•K Paris® online store. These GTC may be modified at any time, with the applicable GTC being those accepted by the Customer when placing their order and which are accessible from the order confirmation email.

The website www.myriamkparis.com (hereinafter referred to as "the Site"), which presents the Myriam•K Paris® online store, is published by MK France, a simplified joint-stock company with a share capital of €100,000.00, with its head office located at 55 Rue Pierre Charron, 75008 Paris. It is registered in the Paris Trade and Companies Register under number 52786424300011 and under the VAT number FR35527864243. The name of the publishing director is Youcef Bennadja in his capacity as president. The host of the Site is Shopify, located at 151 O’Connor St, Ground Floor, Ottawa, ON K2P 2L8, Canada, accessible by email: support@shopify.com.

The Myriam•K Paris® online store allows MK France to offer the sale of products to non-professional customers who are consumers, over 18 years old, and have full legal capacity. Sales are made retail for strictly personal use. Therefore, MK France limits the order to four (4) units of the same item with a maximum of fifteen (15) products purchased by a single customer.

PRODUCTS

The Products offered for sale on the Myriam•K Paris® Online Boutique are described and presented with the greatest possible precision (specifications, illustrations, size, composition, etc.). However, the Customer is invited to refer to the description of each Product, available by clicking on each "Product Sheet", in order to know its properties and particularities, in particular as regards the characteristics sought, the choice and the purchase of a Product being placed under its sole responsibility.

PRICE

The prices applied are those appearing on the Myriam•K Paris® Online Boutique at the time of the order. The Customer is informed that prices are subject to change. Therefore, in the event that the Customer has created a customer account, the prices displayed in the "My account / My orders" section on the summary of orders correspond to the prices paid by the Customer at the time of his previous orders. The functionality allowing the Customer, from this page, ordering a product again is therefore likely to offer the same product for sale at a price different from the price paid on the day of the previous order. The Customer is therefore invited to pay attention to the price in force at the time of the order and when the product is placed in the shopping cart. The prices will be displayed in Euro (€) including VAT, and do not take into account the delivery costs of the order (hereinafter referred to as the "Delivery Costs"). These Delivery Costs will be indicated to the Customer on the basket validation page as well as on the order summary page, before validation and payment of the order.

After validation of your basket, you will be redirected to the payment page of our partner SHOPIFY PAYMENT for optimal security. The payment page does not belong to Myriam•K Paris®, no payment information will be transmitted or stored on the Myriam•K Paris® site.

Once the order has been accepted, you will be redirected to the www.myriamkparis.com website for
see the summary of your order.

Please be careful not to close the payment page before being redirected to our confirmation page which provides your order number. You will receive
also a confirmation email.

Myriam•K Paris® reserves the right to refuse to process an order if it does not provide all the necessary guarantees to ensure compliant and secure payment and in the event of suspicion of fraud or illegal activity according to French and European laws.

All orders involve payment. Appropriate legal action will be taken in the event of fraudulent payment.

3-D SECURE

In order to provide you with a secure transaction, Myriam•K Paris® may trigger the 3D Secure protocol for authentication purposes. After entering your credit card details, you will be redirected to your bank's online page or application to comply with their authentication protocol.

REFUND PROCESS

In the case of a physical return, please follow the instructions explained in our General Conditions of Sale, under the heading: Canceling your order & return policy.

RIGHT TO RETRACT

Upon receipt of the request, your refund will be processed within 1 to 2 working days. Depending on your financial institution, it may take 5-7 business days for your account to be credited.

The order is validated by the Seller only after acceptance of the GCS and verification and confirmation of the validity of the payment.

In any case, the Seller reserves the right to refuse any order or any delivery in the event of (i) the ceilings indicated in the "PAYMENT" article hereof being exceeded, (ii) an existing dispute with the Buyer, (iii ) total or partial non-payment of a previous order by the Purchaser, (iv)

The standard purchase setting is for one-time purchases, and the subscription is an additional service that we offer. It is also possible to combine subscription purchases and non-subscription purchases in a single order.

  1. Already a Customer? If you are already a customer, log in to manage your orders and modify or cancel your subscriptions. Please note that even if you have subscribed to a subscription or placed an order, you do not automatically have an account. You will need to create an account to access your subscription.

GIFT CARDS

1. Purchase and Use

  • Electronic gift cards are available for purchase on our website and can only be used for online purchases on our platform.
  • The purchase of these cards can be made using the payment methods offered at the time of the transaction.
  • Once the purchase is completed, the electronic gift card will be sent directly via email to the recipient specified during the purchase.

2. Validity and Expiration

  • Each electronic gift card is valid for one year from the date of issuance.
  • After this period, the card can no longer be used, and any remaining balance will be considered lost.

3. Amount and Partial Use

  • Gift cards are loaded with a specific amount at the time of purchase.
  • They can be used in multiple transactions until the total balance is exhausted.
  • If a purchase exceeds the card's balance, the difference can be paid using another accepted payment method on our site.

4. Non-Refundable

  • Electronic gift cards are non-refundable and cannot be exchanged for cash or other forms of payment.

5. Transfer and Security

  • Gift cards are transferable. However, we are not responsible for cards that are lost, stolen, or used without permission.

ORDERS

To enter an order, the Buyer must first connect to the Site. The Purchaser then has the possibility of taking cognizance of the
different Products offered for sale on the day of consultation of the Site and to choose its Products by (i) browsing in the different categories of Products or (ii) by directly entering the name of the Product in the search engine.

The Purchaser undertakes to complete the form made available to him in good faith. The Buyer acknowledges that the data it communicates to the Seller and which is stored in the information systems of the Seller and/or its subcontractors is accurate and serves as proof of its identity. It is recalled that this personal data is governed by the Personal Data Policy accessible here . After having read the status of his order, the Buyer is invited:

- Either to click on the button allowing access to the payment of his order, under the conditions described in these GCS,

- Either to click on the button allowing him to modify his basket and/or the information relating to his personal details.

In order to limit the risk of fraud, an order on the Site can only be validated if the Buyer's basket reaches a minimum total amount of €5 (five Euros) including tax (excluding delivery costs) and does not exceed an amount total
maximum of €1,500 (one thousand Euros) including VAT (excluding delivery costs).

By clicking on the button giving access to the payment of the order, the Buyer must first read these
CGV, then in a second step, confirm its agreement on all the CGV by implementing an action of confirmation of acceptance required on the Site (such as for example by ticking a box).

As soon as the Buyer confirms his acceptance of the GCS, an Internet page dedicated to the payment of the order opens.

The Purchaser must then proceed to the payment of his order under the conditions described in
these T&Cs.

It is specified that by choosing immediate payment by credit card, the Buyer will then be automatically switched to the electronic payment server of the payment provider. The payment service provider's server is secured by SSL encryption (Secure Socket Layer) in order to
protect as effectively as possible all data related to means of payment, and that at no time will the Buyer's bank details pass through the Seller's computer system. Its liability is therefore released.

The data recorded by the Seller constitutes proof of all transactions between the Seller and the Buyer.

PURCHASE OF PRODUCTS ON PRE-ORDER.

A product may go out of stock due to high demand or as part of a promotional campaign. In some cases, we offer customers the option to pre-order the product until approximately 2 weeks before it is back in stock. This option allows these customers to be the first to receive the product when it becomes available again.

If a product is available for pre-order, it will be clearly identified as such on the product image in the online store. The estimated shipping or delivery date will also be displayed in the same place.

Pre-order purchases are subject to the same contractual conditions as other product purchases on the online store. However, please see below for information regarding the cancellation and modifications of pre-order products.

If you have made a purchase of a pre-order product, your order will not be shipped until the product is back in stock. This means that you will receive an order confirmation as soon as you place your order, but the money will not be deducted from your account until the product is available in stock, and your order is ready to be packed and shipped. You will receive information by email when your order is shipped, along with parcel tracking details to track the delivery progress.

If you wish to cancel the purchase of a pre-order product or make changes to your order, please contact contact@m-kfrance.com as soon as possible before the order is shipped, and we will do our best to provide you with the necessary assistance.

ORDER CONFIRMATION

Once the order has been confirmed and its payment validated according to the methods provided below, a printable and recordable summary of the order of
the Buyer is displayed and mentions in particular the references of the order.

An order confirmation email is sent as soon as possible by the Seller to the email address provided by the Buyer and includes the following information in particular:

- The identity of the Seller as well as his contact details;

- The reference of the order recorded at the time of placing the order;

- The summary of the order and the essential characteristics of the products;

- Delivery times, costs and possible restrictions;

- The total amount of the order, all taxes included;

- The rights and legal guarantees available to the Buyer;

- Confirmation of payment.

The Seller retains ownership of the Product(s) ordered until full payment of the price and its accessories, including shipping costs, by the Seller.

In the event of a payment incident, the Buyer agrees to return the products received to the Seller, upon first request.

In order to protect the Seller from abusive practices operated by fraudsters, and in the event that the Seller or the online payment provider suspects the fraudulent nature of an order, they reserve the right to ask the Buyer (prior to processing the order) for additional documents (in particular proof of address and debit in the name of the Buyer, photocopy of the card of identity of the Buyer, photocopy of the Buyer's bank card) in order to verify the non-fraudulent nature of the latter.

In the absence of a response from the Buyer within fifteen (15) days following the sending of the request by the Seller or the online payment provider, the order will be canceled and the Seller will proceed within fourteen ( 14) days following the expiry of the above-mentioned period to the reimbursement thereof according to the method of payment used by the Buyer.

PROOF OF ORDER

It is expressly agreed between the Seller and the Buyer that the e-mails are authentic between the Parties, as are the automatic registration systems used on the Site, in particular as to the nature and on the date of the order.

The Buyer can access, if necessary in accordance with the rules of common law, the electronic contract concluded between the Buyer and the Seller. It is for

DELIVERY AND STATUS OF YOUR ORDER

Shipping Costs and Delivery Times

The delivery options for mainland France, Monaco (excluding Corsica) are as follows:

CHRONOPOST SERVICE Chrono 13:
Once your order has been prepared and dispatched by our logistics service, it will be delivered the next day before 1 pm to the address indicated, instead of the usual 48/72-hour delay.
Please note that this 24-hour period starts from the dispatch of your parcel, not from when you place your order.
The day before delivery, you will be notified by email and SMS.

  • CHRONOPOST SERVICE Chrono 13: €8.60 (€5.90 for orders over €75).
    From the day the order is dispatched, not from the day it is placed.

COURIER:
Delivery available in Paris only. Orders prepared from Monday to Friday between 10 am and 3 pm. Delivery within four (4) hours on the same day if the order is placed before 3 pm.

CLICK & COLLECT:
Pick-up at our Paris showroom only: 55 Rue Pierre Charron, 75008 Paris. Orders prepared from Tuesday to Friday between 10 am and 3 pm. Orders can be picked up within three (3) hours on the same day if placed before 3 pm.

Delivery options for DOM-TOM (Overseas Territories) are as follows:

  • Chronopost home delivery with signature: Delivery in five (5) to seven (7) business days.
  • The price is based on the weight of your order.

International delivery options are as follows:
DELIVERY METHOD & PRICE PER ORDER

  • DHL International Delivery: Delivery in five (5) to seven (7) business days.
  • The price is based on the weight of your order.

BELGIUM:
CHRONOPOST Home Delivery with Signature:

  • 48h/72h (two (2) to three (3) business days): Starting from €8.60 (free for orders over €75).

This amount is charged in addition to the price of the products purchased. When summarizing your order and before you confirm it, we will inform you of the shipping fees and the chosen delivery method. Delivery time is three (3) to seven (7) business days after your order is handed over to the carrier.

Shipping to a different recipient and/or gift option:
You can have your purchase shipped to a different delivery address than the billing address (for example, if you want it delivered to your workplace or sent as a gift) as long as both addresses are within the area specified in the Terms and Conditions and the Shipping Policy. When making a purchase, at the delivery address selection stage, simply enter the desired shipping address.

Important Information:
For your security, your billing address must match the one on your credit card statement used for payment. We reserve the right to cancel any order that does not meet these criteria.

Order Tracking and Delivery Confirmation:
Once your order is finalized, you will receive a confirmation email. As soon as a tracking number is assigned to your package, you will receive another email with the tracking number, which will allow you to follow your package.

Order Status:
You can also find the tracking number and order status in the "My Account" section. Log in with your credentials to access your account. You will find your orders listed under "My Orders," displaying the date, amount, and status of each. You can click on "Details" to see more information about your order.

DELIVERY TERMS

Once the order has been prepared, it is sent to the postal address provided by the Buyer when ordering.

The Products are delivered by the CHRONOPOST service provider (depending on the case and/or the delivery options
selected).

In the absence of the Buyer, the Carrier reserves the right to drop off the package at a nearby relay point available the next day. In the event of an anomaly on the delivery, the buyer must then contact the Carrier in order to agree on a new delivery date. It is nevertheless specified that if the Buyer does not contact the Carrier, the package is returned to the sender within 7 days.

The Buyer is informed that the package is kept by the Carrier or relay point for a period of 7 days (7) days after the first presentation, before return sender.

TIME LIMIT

Orders paid by credit card are processed within a maximum of one (1) working day.

It is recalled that an order is only sent once it has been processed.

From the processing of the order, the corresponding Products are sent and
delivered by the Carrier within the following deadlines:

- Delivery to a relay point by Points Relais: 72 hours (three (3) working days)

- Express delivery by Chronopost: 48h/72h (two (2) to (three (3) working or working days)

Sundays and public holidays are not considered working days.

In any case, the order is executed within a maximum period of thirty (30) days from the day following that on which the Buyer validated his order, subject to full payment of the price and compliance with the conditions of purchase.

In the absence of delivery at the end of this period, the Buyer has the possibility of canceling his order under the conditions provided for in the article "Late Delivery" below.

DELIVERY DELAYS

If the maximum delivery period of thirty (30) days is exceeded, the Buyer may exercise his right to terminate the order with Customer Service: contact@m-kfrance.com

From the exercise of the right of denunciation, the Seller carries out a
reimbursement of all sums paid by the Purchaser (delivery costs included), according to the method of payment used within a maximum period of fourteen (14) days from receipt of the denunciation, and this, excluding any other compensation.

In the event of partial delivery, delivery may be made in several instalments, and this right only concerns the undelivered balance of the order.

Any delay in delivery must be reported as soon as possible by the Buyer by e-mail contact@m-kfrance.com , so that the Seller can carry out an investigation with the Carrier. Buyer is informed that the duration of carrying out a survey is random and can be relatively long, the Seller not controlling its realization.

If during this investigation, the order is found, it is immediately redirected to the place of delivery designated in the order.

If at the end of this investigation the loss of the order is confirmed, the seller carries out, at his expense, a reshipment of the Product(s) to the Buyer or in the event of permanent unavailability, reimburses, on the account bank debited at the time of the order, the Purchaser of the sums collected.

CANCEL YOUR ORDER & RETURN POLICY

Cancel your order

- You wish to cancel your order:

Our warehouse prepares orders in the morning from Monday to Friday (excluding public holidays). If you wish to cancel your order, please contact
our Customer Service contact@m-kfrance.com .

If the order has not yet been prepared, we may cancel it.

Otherwise, if your order has already been prepared, we will not be able to cancel the order but you will always be able to refuse the package on delivery directly to the Carrier and we will reimburse you as soon as the return of the package.

Occasionally orders or parts of orders may be canceled by our system.

Return policy

All return and refund requests must be returned, at your expense, within a maximum of fourteen (14) days after the delivery date. The product must be returned to us, obligatorily, in its original packaging, accompanied by the delivery slip and the return slip .

If your entire order is returned according to the conditions stipulated above, we will refund the full amount of your order.

If you have received a promotional gift, please enclose it with your return.

CANCELLATION POLICY FOR IN-PERSON TRAINING BOOKINGS

Myriam•K Paris® offers in-person Brazilian blowout training, a technique introduced to France by our brand in 2009. These training sessions are held at 55 rue Pierre Charron, 75008 Paris, France, and are designed for a full day, including an in-depth theoretical section, practical sessions, a dedicated trainer for the entire day, as well as lunch.

Cancellation Policy:

  • Cancellation up to 72 hours before the training date: Participants may cancel their booking and request a full refund up to 72 hours before the start of the training session.
  • Cancellation up to 48 hours before the training date: If the cancellation is made less than 72 hours but more than 48 hours before the training begins, 50% of the amount paid will be retained by Myriam•K Paris. The remaining half will be refunded to the participant.
  • Cancellation less than 24 hours before the training date: No refunds will be possible if the cancellation occurs less than 24 hours before the start of the training.

Payment Terms:
Payment for the training must be made via bank transfer or credit card before the session begins. All participants will receive a complimentary Myriam•K Paris Brazilian blowout kit.

Additional Information:

  • Location and Access: Training takes place from Tuesday to Friday at the Myriam•K flagship store, accessible via metro line 1 at Franklin Roosevelt station.
  • Target Audience: The training is suitable for both groups and individuals looking to specialize in Brazilian blowouts.
  • Materials to Bring: Participants are required to bring their own brushes and hairdryers.
  • CPF Eligibility: This training is not eligible for the Personal Training Account (CPF).
DAMAGED PRODUCT(S)

If your package has been damaged during the journey, you will have to make complete and precise reservations on the delivery slip when you receive the package. The recourse is exercised against the carrier. (In accordance with article L.133-3 of the French Commercial Code, any reservation must be confirmed by registered letter to the carrier within three (3) days of receipt.)

Then put aside the package and the merchandise(s) and warn as soon as possible quickly as possible our Customer Service by sending by e-mail one or more several pictures. Don't forget to include your order number and contact details in the email.

DELIVERY CONFIRMATION

Each delivery is deemed to have been made as soon as the Product(s) are made available to the Buyer by the Carrier.

It is the Buyer's responsibility to check immediately upon receipt of the Product(s) the conformity and integrity of the Product(s) shipped.

Any anomaly/reservation identified at the time of delivery (in particular late delivery, missing or damaged product) must be reported completely and precisely by the Buyer on the receipt given by the Carrier at the time of delivery.
the provision of the Products and/or confirmed by registered letter to the Carrier within three (3) days of receipt of the order.

Any reservation of this type must be notified in parallel and as soon as possible to the Seller's Customer Service contact@m-kfrance.com .. A copy of the complaint addressed to the Carrier must be attached.

In the event of an input error, in particular of delivery address resulting in a delay or impossibility of delivery, the seller cannot be held responsible. All costs related to the reshipment of the products and the cost of the products due to an input error by the customer, will be borne by the latter.

LEGAL GUARANTEES

In accordance with articles L 211-4 and following of the Consumer Code, the Seller is required to deliver a good in conformity with the order made by the Buyer and must respond to the lack of conformity existing at the time of delivery of the latter. As such, to comply with the contract, the property must:

1° Be suitable for the use usually expected of a similar item and, where applicable:

- Correspond to the description given by the Seller and possess the qualities that the latter presented to the Buyer in the form of a sample or model;

- Present the qualities that a Buyer can legitimately expect given the public statements made by the Seller, by the producer or by his representative, in particular in advertising or labeling;

2° Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the Buyer, brought to the attention of the Seller and which the latter has accepted.

Similarly, in accordance with article 1641 of the Civil Code, the Seller is bound by the guarantee for hidden defects in the thing sold which render it unfit for the use for which it is intended, or which reduce this use so much that the Buyer would not have acquired it, or would have given only a lower price, if he had known them.

If the Products delivered do not conform to the Products ordered by the Buyer or if they have hidden defects, the latter must send an e-mail to the Seller's Customer Service contact@m-kfrance.com . to notify him of the
non-conformity or hidden defects of its Product(s).

In accordance with article L 211-12 of the Consumer Code and 1648 paragraph 1 of the Civil Code, the Buyer has a period of two (2) years from the delivery of the
Products purchased to exercise the guarantee against hidden defects or the legal guarantee of conformity.

Any complaint made after this period of two (2) years from the date of taking possession of the goods in the event of non-compliance or from the discovery of the defect in the event of hidden defects will be rejected and Myriam•K Paris® will be released from all liability.

The Seller's Customer Service acknowledges receipt of the Buyer's request and confirms the procedure to be followed.

Upon receipt of the instructions from the Seller's customer service, the Buyer returns the non-compliant products or products affected by a latent defect to the Seller.

The Product(s) must imperatively be (i) returned complete, unused, in its (their) original packaging intact and (ii) accompanied by its (their) original packaging as well as the return form provided by the Seller's customer service and the invoice.

Furthermore, the Seller does not accept:

(i) parcels sent postage due. Any risk related to the return of the Product(s) is the responsibility of the Buyer.

(ii) parcels deposited directly at a Relay Point. Any return order that would be deposited in a Relay Point cannot be processed and cannot therefore be reimbursed.

Upon receipt of the Product(s) presumed to be non-compliant or affected by a latent defect, the Seller carries out an inspection of the Product(s) to ascertain the
conformity or not of said Product(s).

Similarly, the Seller may carry out a quality test on the Product(s) returned by the Buyer to verify that the Product(s) returned are indeed Product(s). (s) of origin. It is understood that these checks are carried out as soon as possible and within a maximum period of one (1) month.

If the non-conformity of the Product(s) is confirmed or the hidden defect is proven, the Seller will then proceed, at the Buyer's choice:

- either to the reimbursement of the non-compliant Product(s) or affected by a hidden defect as well as the shipping costs, according to the method of payment used by the Buyer, within a period fourteen (14) days after receipt of the non-compliant Product(s),

- either to the exchange of the non-compliant Product(s) or affected by a hidden defect at the request of the Buyer. The sending of the Product(s) to the Buyer is done at the expense of the Seller and according to the conditions of these GCS

CANCELLATION POLICIES

The buyer has a reflection period of fourteen (14) days running, from the day of actual receipt of the order, to return the Product(s) ordered, without having to justify reasons or pay penalties.

The Buyer then has a period of 14 days to return the complete product(s), unused, in its (their) original packaging intact and, as far as possible, accompanied (s) of its (their) original packaging(s) as well as the return slip, and a copy of the invoice.

If the products are not returned within fourteen (14) days, from the day of actual receipt of the order, the order is deemed final and no refund can be made, with the exception of the cases provided for in these T&Cs

Upon receipt, the Seller acknowledges receipt of this request by sending an e-mail or letter.

The Seller undertakes to reimburse the Buyer for all sums paid. The refund is made according to the method of payment used by the Buyer, in a maximum period of fourteen (14) days after the exercise of the right of withdrawal by the Buyer.

Reimbursement of this sum may, however, be deferred until the recovery of returned goods. The return is the responsibility of the Buyer.

Activity as Data Controller

MISCELLANEOUS TERMS

a. Force majeure

No Party is liable for the total or partial non-performance of its obligations under this contract, if this non-execution is caused by an event constituting force majeure.

Are considered as cases of force majeure events fulfilling the criteria set by the case law of the Court of Cassation and the legislation.

The Party invoking an event constituting force majeure must notify the other Party within five (5) working days following the occurrence of this event.

The Parties agree that they must consult each other as soon as possible in order to jointly determine the terms of execution of the order during the
duration of the case of force majeure.

Beyond a period of one (1) month of interruption due to force majeure, the Seller may not honor the order, on condition that it reimburses the Buyer if necessary.

b. Partial invalidity

If one or more stipulations of the these T&Cs are held to be invalid or declared as such pursuant to a law, regulation or following a final decision of a competent court, the other stipulations retain their full force and scope.

c. Entire contract

These T&Cs and the order summary sent to the Buyer form a contractual whole and constitute the entirety of the contractual relations between the Parts. In the event of any contradiction between these documents, the T&Cs shall prevail.

d. Modification of the T&Cs

It is specified that the Buyer may save or print these T&Cs on condition that you do not modify them.

The current GCS can be consulted at any time under the section "General Conditions of Sale" accessible via all the pages of the Site.

The Seller may at any time update these T&Cs. Such an update is the subject of prior and specific notification on the Site.

e. Applicable law

These T&Cs and the relationships contractual between the Buyer and the Seller are subject to French law.
